Recruitment License

Whether you are involved in domestic or outbound recruitment business, a recruitment license will be required from the Department of Employment, of the Ministry of Labour. However, the same company cannot operate both domestic and outbound recruitment business.

Director

The only person authorized to bind the organization in legal documents pertaining to the recruitment activity is a Thai director. A majority of Thai directors are required to serve on the board of the recruiting company, but their scope of authority is only required to include matters related to the recruitment industry. A criminal report that is empty must be available from the Thai director. A majority of Thai citizens should also be the shareholders in a recruitment firm.

Office Space Requirements

The office area (having minimum area of 16 square meters) should be clearly separated from other offices, and have a clear signboard with the full company name at the entrance. Sufficient documents should be provided by the legal owner of the property including a consent letter to evidence permission to use the address for recruitment business. Do note, virtual or serviced offices are usually not considered sufficient to operate a recruitment business.

Other Obligations

A security deposit is required to be made at the Department of Employment throughout the application process. The payment of the security fee serves as proof that the business has enough money on hand to cover any fines associated with failing to uphold its license obligations. The payment will be kept on file until the recruitment license is no longer necessary.

Once a recruitment license has been granted, the company’s name and stated goals should be changed to include the words “recruitment,” “manpower,” or any other similar-sounding words. The recruitment license is good for consecutive terms of two years.

OUTBOUND RECRUITMENT :

Registered capital : One million Thai Baht is the minimal capital requirement.

Shareholders : At least 75% of the outstanding share capital must be held by Thai shareholder(s).

Directors: Directors must be appointed in a 3:1 ratio, with more Thai directors than foreign directors.

Security fee: It is possible to deposit 5,000,000 THB as cash, bonds, or a bank guarantee.

Cost of the recruitment license: 10,000 THB
