The capital and employee criteria for businesses promoted by the Thai Board of Investment are different from those for other limited corporations. Instead of contacting the Labor or Immigration departments separately, foreign nationals employed by BOI-promoted businesses can receive their visas and work permits via the One Stop Service Centre for Visas and Work Permits. Once the online registration process is approved, the actual process can be finished in a single day.
Application Process
The visa and work permit application process consists of the following steps:
Step-1
If you want help with the application through the BOI E-Expert system for a foreign skilled worker to work in your BOI promoted company, get in touch with Thaipan Legal. To support the foreigner’s application for a Non-immigrant B visa, an invitation letter may be requested from the BOI office. This online application process takes around a week to complete.
Step-2
The foreigner can apply for a non-immigrant business visa (90 days) at the Thai Embassy or Consulate in his home country or another country depending on his nationality by mailing the invitation letter issued by the BOI office to him along with supporting company registration documents bearing the signature of the authorized director.
Step-3
The next step is for Thaipan Legal to submit an online request to “open a position” for the foreign national to work for the company. This request will include information about the foreign national’s position, job description, prior employment history, and educational background. It will also require supporting documentation and certificates. Online consideration is conducted over the course of around a week for the available post.
Step-4
The BOI E-Expert system allows for the submission of the application for the foreign worker’s work permit and visa extension once the position has been opened and accepted. This is the last step of online approval before the work permit booklet and visa extension are physically issued. It takes this process 3 to 4 business days.
Step-5
The legal team at Thaipan Legal will physically accompany the foreign applicant after the online formalities are finished so that they can pick up the work permit booklet from the Employment Office and have their visa extended at the Immigration Bureau, both of which are located at the One Stop Service Centre for Visas and Work Permits.
